It's just good business to state your policies up front so that there are no issues down the road. I "try" and do the same when I'm BSTing.

Like you said, it has been five years and 3A has grown. I think they are entitled to change their policies as they see fit, like implementing the 5% cancellation fee. It may be a bummer to those who don't want to pay that 5% but now it shouldn't be a surprise, not on the Sunday Morning pack anyways.
Those who were forced to pay the 5% prior to this new change should not have, seeing as the above statement was in play (assuming there wasn't a public announcement overriding it).
Either 3A needs to make a general announcement or attach that 5% notice on every future sale, or both.

i think you misunderstood my point - i knew that there was always a cancellation fee, but ash's statement basically says that the fee will be waived if the product is delayed.
which is fair to all parties, i think. if i cancel a preorder before it's advertised shipping date, that's me breaking the 'preorder contract', and there should be a penalty on me. if they break the contract by not delivering on a promise, i shouldn't be penalized for it.
and yeah, i know it can be argued that they are estimates, but they could easily pad it to be realistic, or at least make room for the seemingly inevitable delays.
there is no scenario where 3a looks good if an item is delayed -- if an item is delayed due to unforseen circumstances, it makes them look incompetent; if they knowingly issue a shipping estimate they can't possibly keep, then that's just lying (wouldn't be the first time, though).

During the Hotfoot sale I bought Hootfoot but then a few min later a Charfoot turned up so I cancelled Hotfoot but had to pay 5% to cover PayPal fees.

Oh boy, I was charge 5% for canceling soot panda and Nise purchase when it was pass its delivery date.
Soot panda delivery date was put as last qtr 2014 but when it did not get delivered I cancel it on 7 Jan 15 and for Nise it was 1st qtr 2015 and I cancel it in 6 May 2015. If I had known that Ash had put it in writing that they will refund in full if delivery date went pass the original targetted date I will have sound out to CS so that I won't be penalise for no fault of mine

I'm curious to know if CS knows that Ash stated the full refund policy. If you contact them I'd supply the quote that Ash made.

Not saying I agree or disagree, but something written 6 years ago will in all likelihood not apply to current orders. Policies and fine print are constantly changing.

I've had to pay 5% on items that are still within their shipping estimate, which is fair, but not when they're passed it which is also fair.

There isn't a claims court in the Land that would fail to give full recovery for non performance by ThreeA when it came to a figure that was several quarters past its shipping date. Dates, even estimates, are contractual terms and binding on parties. No ThreeA policy can void that.
A 5% fee, for whatever reason (PayPal etc) is reasonable when you decide to break the contract but after a reasonable period of time ThreeAs non performance means you are not 'breaking' the contract as they already have, the remedy - be it wait for the figure or seek remuneration of funds is your choice.
That said... Loving the Sunday Gang but saving pennies.

A friend of mine said he cancelled a few orders but still had to pay the 5%. He argued the items were months overdue and that threea were breaking their contract but he was more or less told he could either accept the 5% or else wait for the item. I've since heard the same thing happened to a lot of people, very bad way to treat your regular/loyal customers.

Well in the UK you just take that correspondence to the small claims court. There is zero doubt you'll get full compensation and costs. Rules on non-delivery and estimate dates are well established.

doubt it -- 3a is a hongkong- based company, afaik, so the courts will be unlikely to entertain it.

Companies selling into a jurisdiction are bound by all laws of that jurisdiction, including consumer protection and rules on dispute resolution. A court order will be levelled against any company assets in the country, including any further items imported. Any legal advice will be to settle and save themselves a ball ache.
